KEGSHOE™ Privacy Policy

Kegshoe Inc. (“Kegshoe”, “we”, “us” or “our”) provides a keg tracking solution through our mobile application (the “Kegshoe App”), website www.kegshoe.ca and other online products and services (together, the “Service").

This privacy policy (the “Policy”) outlines how we collect, use, disclose, manage and safeguard your personal information.

For the purposes of this Policy, “personal information” means information about an identifiable individual.

Kegshoe will collect personal information from you when you access and use the Service. By accessing or using the Service, you are agreeing to the terms of this Policy.

1 Information We Collect

Kegshoe will collect information from you when you access or use the Service, including when you register for an account (“Account”) with Kegshoe.

Registration and Account Information

When you create an Account with Kegshoe we will collect certain information from you, including:

• first and last name
• mailing address (including city, province and postal code)
• email address
• phone number

Payment Information

When you make or receive a payment through the Service, we will collect your credit card, debit card or banking information and other financial data. However, we do not store this payment information. We use a third-party payment processor (Stripe) to process all payments. The use and storage of payment information is governed by the payment processor’s applicable terms of service and privacy policy.

Third-Party Information

When you use the Service, we may collect information of third-parties that you provide to us or authorize us to collect, including the personal information of your customers, friends or colleagues (“Third-Party Data”). You are responsible for obtaining the necessary consent for the collection and use of Third-Party Data and for the disclosure of this data to us.

Log and Website Information

When you access and use the Service, we may automatically collect certain technical information about your visit, including the date, time, browser type, your internet service provider, your IP address, device information (including device identifiers), geo-location information, computer and network performance data, the URL that you are coming from and your navigation history in order to customize and personalize your experience on the Service, improve our Service and for statistical research purposes.

Location Information

Kegshoe’s Service is all about tracking kegs. As a result, the Service will collect the location of kegs and the Kegshoe App will access and use the precise geo-location of mobile devices running the App to help track kegs. This location information is used to track and update the status of kegs and to facilitate up-to-the minute keg deliveries and pickups. The Kegshoe App will only access and use your mobile device’s location information if you give the App permission through your device settings or the App.

Camera Functionality

The Kegshoe App may also access and use your mobile device’s camera to scan barcodes associated with kegs to help track kegs. The Kegshoe App will only access and use your device’s camera if you give the App permission through your device settings or the App.

2 Use and Disclosure of Your Information

We will use your personal information to provide, maintain, and improve our Service and learn about our user base.

Identification and Verification

We will use your personal information to verify your identity and the information that you provide to us.

Account Administration

We may use your personal information to communicate with you about our Service and your Account and to provide you with technical support.

Third-Party Service Providers

We may transfer your personal information to a third-party service provider for processing and storage. Whenever we engage a third-party service provider, we ensure that the information is properly safeguarded at all times at a comparable level of protection the information would have received if it had not been transferred.

We may transfer your personal information to a third-party service provider outside of Canada. In the event that your personal information is transferred outside of Canada, the government, courts or law enforcement or regulatory agencies of that jurisdiction may be able to obtain disclosure of your personal information through the laws of that jurisdiction.

We reserve the right to disclose your personal information as required by law, when we believe that disclosure is necessary to comply with a judicial proceeding, court order, or legal process served on us and to defend against legal claims. We may also disclose your personal information to investigate the breach of an agreement.

Corporate Matters

We may disclose and share your personal information to explore and/or undertake a corporate transaction, including a merger, acquisition, amalgamation, IPO, reorganization or sale of Kegshoe. Your personal information will be used and disclosed solely for the purposes related to the transaction and will be protected by security safeguards appropriate to the sensitivity of the information.

3 Anonymized Information

We reserve the right to use anonymized and aggregated information for product development, research and advertising and marketing purposes.

4 Retaining Your Information

If you want us to permanently delete your personal information from our servers, please send an email to [email protected]. We will ensure your information is deleted in a reasonable time after receiving that request.

So long as your Account remains active, we will preserve your personal information.

We will retain any and all personal information that we are required to retain under any applicable laws for the full duration of time required under those laws. We may also retain any anonymized and de-identified information and continue to use this information in accordance with this Policy.

5 Keeping Your Information Secure

Your personal information will be protected by security safeguards appropriate to the sensitivity of the information.

There is no guarantee against data breaches. However, we have taken reasonable measures to prevent a breach. In the event of a data breach, we will:

• Notify users at the first reasonable opportunity of the breach; and
• Apply remedial measures.

6 Cookies

We use “cookies” to collect information and improve the Service. A cookie is a small data file that we transfer to your computer or mobile device. We may use “persistent cookies” to save your user ID and login password for future logins to the website. We may use “session ID cookies” to enable certain features of the website, to better understand how you interact with the website and to monitor aggregate usage and web traffic routing on the website. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. Kegshoe may use the data collected from “cookies” and web browsers for its own purposes, both related to and unrelated to improving our Service. In the event we disclose this data to any third-party for any purposes, it will be used anonymously and stripped of any and all personal or identifying information.

7 Children and Minors

We do not knowingly collect, use or disclose personal information from children under the age of 13. If you are the parent or legal guardian of an individual under the age of 13 who may have provided us with personal information, please contact us to have this information removed.
